All raffle proceeds support The Red Devils, Inc. (TRD), a registered 501(c) (3) charitable organization based in Baltimore. TRD’s mission is to fund services that improve the quality of life for breast cancer patients and their families. TRD is located at 5820 York Road, Suite 200, Baltimore, Maryland 21212.
Tickets and payment confirmation will be provided electronically at time of purchase and raffle tickets will be sent to you via e-mail. If no email address is available, tickets will be sent to you via U.S. Postal Service.
DESCRIPTION OF RAFFLE
TRD, the sponsor of this raffle, is offering the opportunity to become eligible for a drawing to win multiple prizes, including the Grand Prize winner’s brand new 2012 Nissan Rogue MSRP w/Destination $24,520.
Up to 2,000 raffle tickets will be sold for $100 each to the general public unless purchased through Groupon for $50 each. 100% of the proceeds benefit TRD, a 501(c) (3) nonprofit. If fewer than 1,000 tickets are sold by November 3, 2012, the raffle reverts to a 50/50 raffle, with 50% of the raffle proceeds awarded to the winner, in lieu of the other listed final drawing prizes described below.
TRD’s Get a Ride, Give a Ride Car Raffle is a nonprofit raffle registered with the Baltimore County Department of Permits, Approvals and Inspections.
HOW TO ENTER
You may enter the Get a Ride, Give a Ride 2012 Car Raffle in any of the following ways:
(1) Online at http://thereddevilscarraffle.kintera.org. Purchaser must provide a valid e-mail address, full legal name, home phone, and physical mailing address.* Entries must be received by 10 p.m. November 2, 2012.
If you don’t receive your ticket via e-mail, first check your spam folder, then e-mail TRD to receive a copy of your ticket receipt – jan@the-red-devils.org.
(2) Through Groupon as a Featured Deal beginning September 10, 2012 through September 14, 2012, and again as a Featured Deal on October 10, 2012 for three days (www.groupon.com/baltimore). Purchaser must adhere to Groupon’s membership and transaction requirements, and must provide an email address to receive your ticket.
(3) By mail using the Ticket Reservation Form available online at http://thereddevilscarraffle.kintera.org and in the Get a Ride. Give a Ride Car Raffle brochure. Entries must be received by TRD by 10 p.m. November 2, 2012.
(4) In person at The Red Devils Bull and Oyster Roast on November 3, 2012 at Columbus Gardens, 403 Klosterman Ave. Baltimore, MD 21236 from 7 p.m. until 9:55 p.m.
*If you don’t provide an e-mail address, a copy of your numbered raffle ticket(s) will be mailed to the provided mailing address. Entries requiring tickets by U.S. Postal Service must be received by 5 p.m. October 31, 2012.
TRD is not responsible for printing errors in any drawing-related material, or for lost, late, misdirected or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of TRD and will not be returned.
All sales are final unless otherwise specified in these official rules. No raffle ticket refunds will be made.
TRD will reject any drawing ticket request if the check or credit card payment is not honored or is returned due to insufficient funds or any other reason prior and not remedied before the time of drawing. Correction of any such return for non-payment is the responsibility of the ticket purchaser.
RAFFLE DRAWINGS
The raffle final prize drawings will be on November 3, 2012, at 10 p.m., and will take place at The Red Devils Bull and Oyster Roast held at Columbus Gardens, 403 Klosterman Ave., Baltimore, MD 21236. The winner need not be present to win.
Ticket sales are limited to 2,000. Only official raffle tickets will be drawn. No facsimiles permitted.
Additional prizes may be added to the raffle; however, the raffle includes at least four (4) prizes, so your odds of winning are 1:500 or better, depending on the number of tickets sold and the final number of prizes raffled.
Void where prohibited or restricted by law. All federal, state and local laws and regulations apply. No employees or members of the board of TRD, or their direct family members (defined as spouses, parents, children, or any other family members who reside with the winner) are eligible to participate.
Each eligible entry will be sequentially assigned a unique 4 digit number ranging from 0001 to 2000. All raffle ticket numbers assigned will be included on tickets in a raffle tumbler. The raffle tumbler will be spun, and winners drawn, at 10 p.m. on November 3, 2012. The order of winning tickets drawn is as follows – Grand Prize, First Prize, Second, and Third Prize. Each winner’s name, ticket number, and town they reside in will be announced.
All winners will be contacted by phone, e-mail, and/or certified letter within 24 hours of being drawn.
Final Prize Drawings
The Grand Prize is 2012 Nissan Rogue S AWD, sales tax free.
You must be 18 years or older to win any prize and present evidence of adequate insurance before vehicle delivery will occur. Winner may upgrade, for additional cost difference to be paid by winner, to a higher trim level or another vehicle, based on availability through Nationwide Motors. Winner must take vehicle delivery within 60 days of the raffle drawing date.
“Sales tax free” means TRD is responsible to pay Maryland’s State sales tax owed on the Grand Prize. Winner is responsible for additional State sales tax incurred by upgrading to a higher trim level. Upon choosing a winner, and the winner selecting a prize, an estimation of Federal and State Withholding Taxes is made by TRD. Before vehicle delivery can occur, the winner is responsible for paying TRD the estimated Federal and State Withholding Tax amount and completing and signing Form W-2G, Certain Gambling Winnings, both to be submitted by TRD to the IRS on winner’s behalf. Winner is responsible for all other fees including, license, title, registration and/or similar fees associated with receiving the prize. To claim the prize, the winner may be required to provide proof of identity, sign an affidavit of eligibility/liability/terms and liability and conditions/publicity releases (“Release”), and complete IRS Form W-9, and any other forms required by law. In the event that the winner fails to pay the required taxes, the car will not be delivered and the winner will not be eligible for any prize. In such event, another winner will be selected.
TRD will make all reasonable efforts to deliver the raffle prize vehicle as described in these Rules to the winner within 60 days of the November 3, 2012 prize drawing. However, if there are no such vehicles available within a 100 mile radius of Baltimore, MD, then TRD and delivery dealer agree to provide the winner with the winner’s choice of an equally priced or more expensive substitute vehicle, and apply the Grand Prize vehicle’s full MSRP value against the purchase of the substitute vehicle. The winner will be required to pay any price difference between the Nissan Rogue, MSRP ($24,520) and the substitute vehicle’s MSRP.
The depiction of the prize vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the winner. However, every reasonable effort is being made to award the exact vehicle displayed at events, in raffle promotions, and on the raffle website.

To claim the prize, the winner will be required to provide proof of identity, sign an affidavit of eligibility/liability/terms and liability and a Release, and complete IRS Form W-9, and any other forms required by law. Before prize delivery can occur, the winner is responsible for paying TRD the estimated Federal and State Withholding Tax amount and completing and signing Form W-2G, Certain Gambling Winnings, both to be submitted by TRD to the IRS on winner’s behalf. In the event that the winner fails to pay the required taxes, the prize will not be provided and the winner will not be eligible for any prize. In such event, another winner will be selected.
Third Prize is an Apple iPhone 4S, 8 MP iSight camera, iOS 5 and iCloud with a retail value of $399.00. Winner is responsible for paying for phone and data service.
To claim the prize, the winner will be required to provide proof of identity, sign an affidavit of eligibility/liability/terms and liability and a Release, and complete IRS Form W-9, and any other forms required by law. Before prize delivery can occur, the winner is responsible for paying TRD the estimated Federal and State Withholding Tax amount and completing and signing Form W-2G, Certain Gambling Winnings, both to be submitted by TRD to the IRS on winner’s behalf. In the event that the winner fails to pay the required taxes, the prize will not be provided and the winner will not be eligible for any prize. In such event, another winner will be selected.
50/50 Cash Raffle Possible Outcome
If the raffle outcome results in fewer than 1,000 tickets being sold by the final drawing date, the ticket proceeds are split 50/50 with the one drawn winner in lieu of the multiple prizes described above.
TRD will first estimate, deduct, and submit Federal and State withholding taxes to the IRS from the 50% proceeds awarded the winner. Winner will receive a check for the remaining 50/50 prize money, after these deductions, and upon completion and signature of Form W-2G, Certain Gambling Winnings and Form W-9. TRD will submit the winner’s W-2G and estimated Federal and State Withholding taxes on winner’s behalf.
WINNER NOTIFICATION
The winners will be announced at the drawing by name and verified by matching the ticket number with the information provided in the records. All winners will be notified by telephone, email, or certified mail, return receipt requested based on the information provided at ticket purchase. Notification by telephone will be attempted on the day of drawing. If phone contact with winner is not made within 24 hours of prize drawing, contact by Email or U.S. certified mail, return receipt notification will be attempted.
If the winner does not respond within ten (10) days, TRD will make one additional attempt to notify the winner via registered mail. Failure of the raffle winner to respond within 20 days of the raffle drawing date will constitute a forfeiture of the prize, and a new winner will be selected.
TRD is not responsible for any delays or obstacles in notification due to (a) erroneous contact information; (b) any outage or delay in Internet service or access; or (c) any other circumstances which may delay or prevent a winner from receiving the prize notifications.
Eligibility and Limitations
Winner need not be present to win. This raffle is only open to U.S. Residents at least 18 years of age, and is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. This raffle shall be governed by the law of the State of Maryland, and the Official Rules are subject to change at any time without notice. TRD shall make all decisions related to the raffle in its sole discretion. By participating, you agree to be bound by these Official Rules and the decisions of TRD and waive any right to claim ambiguity in the raffle operation or Official Rules.
No employees or members of the board of TRD or their direct family members (defined as spouses, parents, children, or any other family members who reside with the winner) are eligible to participate. No person engaged in the marketing, development, production or distribution of raffle materials or prize supply for this drawing is eligible to participate, nor is any person who resides in any area where this drawing, a game of chance, would otherwise be prohibited by law.
The prize may be forfeited if selected entrant(s): (1) cannot be reached; (2) fails to obtain all signatures on the Release and/or to return required documents in a timely manner as required pursuant to these Official Rules; or
(3) cannot accept or receive prize for any reason.
1) By participating in the raffle, you agree to release and hold TRD and its directors, officers, employees and agents, harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the raffle, including from your winning or use of any prize. TRD makes no representations or warranties, expressed or implied, about the raffle or the prizes awarded.
2) Any or all of your entries will be disqualified at the sole discretion of TRD if you attempt: (a) to enter the raffle through any means other than as described in these Official Rules; or (b) to disrupt the raffle, circumvent the terms and conditions of these Official Rules, or in any way tamper with the raffle. If either of the above occurs, TRD has the right to remedy any such action, disruption, or circumvention, and to seek damages from you to the fullest extent permitted by law.
3) TRD is not responsible for error, omission, interruptions, deletion, defect, delay in operations, theft or destruction or unauthorized access to or alterations of entry materials, or for malfunctions of any kind, or inaccurate or failure to receive entry information or any combination thereof. TRD is not responsible for any entries that are late, misdirected, incomplete, or altered. TRD reserves the right to cancel the raffle for any reason.
4) TRD cannot give advice with regard to income tax consequences or deductibility with respect to the raffle ticket purchases or the raffle winner. Please consult your tax professional.
5) TRD shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the prize provided pursuant to the raffle.
6) The depiction of the prize(s) in any advertising or promotional materials may not reflect the actual prize(s) awarded delivered to the winner. However, every effort is being made to award the exact prizes displayed at events, in raffle promotions, and on the raffle website.
7) Upon the 1,000th ticket sale, the raffle winners chosen will receive, subject to these Official Rules, the awarded prize(s).
Awarding of Prizes
Except as stated herein, there shall be no substitution allowed for the listed prizes by a winner. A prize winner, however, may transfer the right to claim the prize. All federal, state and local taxes associated with receipt or use of prizes, including without limitation all applicable sales, use, luxury, income and special taxes are the sole responsibility of the winner.
Winners of all prizes, with the exception of the First Prize, must claim their prize within twenty days from date of drawing or forfeit the prize.
1) Winners will be drawn and announced at The Red Devils Bull and Oyster Roast, Columbus Gardens, 403 Klosterman Ave, Baltimore, MD 21236 on November 3, 2012 at 10 p.m. Prize winners are responsible for all associated fees, which include but may not be limited to license, title, registration fees and/or similar fees associated with receiving the prize.
2) The Grand Prize vehicle must be picked up by the winner at Nationwide Nissan, 2085 York Road, Timonium, MD 21093, 866.274.3765, within 60 days of the prize drawing.
3) Acceptance of a prize constitutes permission for TRD and/or its designees to use the winner’s name, location, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, the winner to the extent permitted by law.
